Nintendo lawsuits for copyright infringement are common in many countries. However, a Russian podcaster is betting that its reach doesn't extend to his increasingly isolated nation. Kotaku spoke to Fedor Volkov, who purchased an imported handheld nine days before the Switch 2 release date.
After an unboxing video, the gamer confirmed some Switch 2 specs and options available in its settings. Also, Volkov explained that a day-one update is necessary to boot Switch games. Still, the footage was one of the most detailed hands-on looks at the console yet. The podcaster was even unafraid to show his face at one point.
Through mutual contacts, Volkov arranged to buy a Switch 2 from a seller who was flying into Russia from Dubai. He soon obtained a handheld, paying the equivalent of around $800. Since Nintendo ceased sales in the country in 2022, gamers have used similar methods to acquire games and consoles.
Volkov believes that, with a negligible presence in the country, Nintendo lacks the jurisdiction or means to pursue him. He also justifies his Switch 2 leaks by pointing out that he purchased the console and never signed an NDA. Of course, many legal experts would argue that it's not wise to underestimate the company's influence. A Nintendo lawsuit has been filed against a company in Russia before.
In 2022, Nintendo sued KupiVip, the business that operated an affiliated online store in Russia. The details are murky, but it's believed that the closure of the business prompted Nintendo to seek compensation. Still, Volkov doesn't claim to run an established company. It's debatable whether Nintendo will make the effort to find his whereabouts. For now, it's easier to ensure that YouTube and social media sites swiftly remove Switch 2 leaks.
