After the Court of International Trade ruled to revoke the tariffs imposed by the Trump administration, the United States Court of Appeals for the Federal Circuit in Washington reinstated the tariffs temporarily, considering the administration’s appeal.
The court ordered the plaintiffs to respond to the appeal by June 5 and the Trump administration by June 9. This blocks the ruling made by the trade court, which ordered an immediate invalidation of the tariffs.
On social media, the Trump administration shared a statement saying that courts are trying to block “the president’s power and the policies he was elected to enact”.
According to the trade court, Congress has the exclusive authority to regulate commerce with trading partners, a constitutional mandate that the Act under which tariffs were imposed cannot be overridden.
“The Worldwide and Retaliatory Tariff Orders exceed any authority granted to the President by IEEPA to regulate importation by means of tariffs,” said the ruling.
The tariffs are still in force and could get to the US Supreme Court, which could be the last instance for the case.
