A handful of Foundation Series Tesla Cybertrucks have made their way onto online actions and used car sites, defying Tesla's anti-resale policy and earning at least one owner a ban from buying Cybertrucks in the future.

Shortly before the Tesla Cybertruck launched, we reported on the anti-resale clause that Tesla had placed in the Cybertruck's purchase agreement. There was some back and forth about whether Tesla would actually keep the clause in the final agreement, and online discourse at the time questioned whether the company would actually enforce the punitive measures.

It turns out some Tesla Cybertruck owners have already been brave enough to test Tesla's willingness to enforce its anti-resale clause. One Cybertruck from an owner in California was recently listed on Doug DeMuro's Cars & Bids auction site, where it garnered bids of up to $158,000, falling short of the hidden reserve, before the auction closed.

While it does not appear that this particular owner has earned the ire of Tesla, apparently having received approval for the resale prior to the listing on Cars & Bids, according to the extensive comment thread on the site, other owners have not been so lucky.

One Cybertruck owner recently posted on the Cybertruck Owners Club about his experience trying to sell the Cybertruck. According to the post, the owner listed their Cybertruck on multiple sites with the VIN number in the listings. Shortly after listing the electric pickup truck for sale, Tesla contacted him to inform him that the other two reservations he had placed for the Cybertruck would be canceled, and the deposits for any future reservations he makes will be forfeited.

I think they got me on CarGurus but who knows. Yes, VIN was listed. I listed it for a ridiculous number because I thought it was funny. $242,069. - malinecentral on Cybertruck Owners Club

It's unclear why the owner who listed his Cybertruck on Cars & Bids managed to get an exemption, other than that he contacted Tesla and requested one. However, it seems clear that, while nobody has seemingly been taken to court or made to pay the $50,000 penalty yet, Tesla is ready to enforce its strict no-resale policy.
